Important: These pages are intended as practical beta legal documents for SkinMorph. They should be reviewed by a qualified attorney before broad public launch, paid plans, mobile app launch, or major public Gallery promotion.
1. Acceptance of Terms
These Terms of Service govern your access to and use of SkinMorph, including the website, app, editor, models, image tools, local projects, cloud projects, profiles, Gallery, remix features, exports, and related services.
By using SkinMorph, creating an account, saving a project, uploading content, posting to Gallery, enabling remix, exporting content, or accessing any SkinMorph feature, you agree to these Terms and any additional policies linked from SkinMorph, including the Privacy Policy and DMCA Policy.
If you do not agree, do not use SkinMorph.
2. Beta Status
SkinMorph is currently in beta. Features may change, break, move, be limited, or be removed. Projects, cloud saves, Gallery posts, remix files, profiles, previews, exports, and local browser saves may not always save, load, render, sync, or display perfectly.
SkinMorph is provided on an as-is and as-available basis during beta. You are responsible for keeping backup copies of important project files, source images, exports, and screenshots.
3. Accounts and Profiles
You may need an account to use cloud saves, Gallery, profiles, uploads, remix, paid features, or other account-based features. You are responsible for your account activity and for keeping your login access secure.
You may not impersonate another person, brand, tattoo shop, artist, celebrity, public figure, organization, or SkinMorph representative. SkinMorph may remove usernames, profile content, or accounts that appear misleading, infringing, abusive, or risky.
4. User Content and Uploads
“User Content” means images, artwork, tattoo designs, flash sheets, logos, screenshots, AI-generated images, profile content, titles, descriptions, project files, Gallery posts, remix files, comments or reports if added, and any other content you upload, create, save, import, export, post, or share through SkinMorph.
You keep ownership of User Content you own. However, you grant SkinMorph Studio LLC d/b/a SkinMorph the rights needed to operate the app, including hosting, storing, copying, processing, resizing, previewing, displaying, backing up, transmitting, moderating, and supporting your User Content as needed to provide SkinMorph features.
You represent that you own your User Content, created it, have permission to use it, or otherwise have a lawful basis to use it in the way you choose. SkinMorph does not verify that uploaded content is original, licensed, non-infringing, safe, lawful, cleared for tattoo use, cleared for commercial use, cleared for public display, or cleared for remixing.
Uploaded images may include personal, body, tattoo, or identifiable visual information. Do not upload images of another person unless you have permission. Do not upload sensitive personal information, private body images, medical information, identification documents, or content you would not want processed by SkinMorph or its service providers.
SkinMorph does not pre-screen all User Content and is not responsible for verifying ownership, permissions, legality, tattoo safety, or suitability before content appears, is processed, or is shared.
5. Public Gallery and Remix
Private/local projects and public Gallery posts are different. Public Gallery posts may be visible to other users and can create copyright, trademark, privacy, publicity-rights, attribution, and impersonation risks.
Do not post content to the public Gallery unless you have the right to share it publicly. Do not post someone else’s tattoo art, shop artwork, logo, brand asset, photo, character, celebrity image, or AI output unless you have the rights or permission needed for public posting.
If you submit content to the public Gallery, you grant SkinMorph Studio LLC d/b/a SkinMorph a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, resize, preview, distribute, moderate, promote, and show that content within SkinMorph and related SkinMorph discovery, profile, Gallery, remix, moderation, support, and promotional features.
If you enable remix on a Gallery project, you grant other SkinMorph users a non-exclusive license to open, download, copy, modify, remix, and reuse that editable project inside SkinMorph, subject to the remix settings and SkinMorph’s rules. Do not enable remix unless you have the right to grant other users that permission.
Removing a Gallery post, deleting an account, or disabling remix may not automatically remove copies, exports, screenshots, cached versions, backups, or remixed projects already created by other users. SkinMorph may remove or restrict remixes where appropriate after a valid rights complaint or policy review.
Creator credit does not replace legal permission. You are responsible for deciding whether content is safe and lawful to upload, post, export, or make remixable.
6. Prohibited Content and Conduct
You may not use SkinMorph to upload, post, share, export, remix, or distribute content that is illegal, infringing, misleading, harmful, abusive, harassing, hateful, sexually exploitative, nonconsensual, spammy, malicious, deceptive, or otherwise inappropriate.
You may not upload private identification documents, medical records, financial records, passwords, confidential information, malware, stolen artwork, nonconsensual images, or content that violates another person’s copyright, trademark, privacy rights, publicity rights, contractual rights, or other legal rights.
You may not copy, scrape, reverse engineer, interfere with, overload, bypass, exploit, or misuse SkinMorph, its code, accounts, security, storage, models, Gallery, APIs, authentication, or payment systems.
7. AI and Automated Tools
Some SkinMorph features may use automated or AI-assisted tools, including background removal, image cleanup, moderation, or other image-processing features. Automated results may be inaccurate, incomplete, distorted, or legally unsafe for your intended use.
You are responsible for reviewing outputs before saving, exporting, tattooing, posting, remixing, or relying on them. AI-assisted editing or background removal does not mean SkinMorph has checked ownership, licensing, copyright, trademark, privacy, publicity rights, tattoo safety, or commercial-use rights.
8. Moderation, Removal, and Termination
SkinMorph Studio LLC d/b/a SkinMorph may remove, restrict, disable, hide, moderate, delete, or limit content, projects, Gallery posts, profiles, accounts, uploads, or features at any time if SkinMorph receives a complaint, believes content may violate these Terms, believes content may create risk, or believes action is needed to protect users, rights holders, the public, or SkinMorph.
SkinMorph is not obligated to monitor or pre-screen every upload, project, Gallery post, remix, export, or user interaction. SkinMorph may review content manually or with automated tools, but users remain responsible for their own content and conduct.
SkinMorph may suspend or terminate accounts that repeatedly violate intellectual property rights, upload prohibited content, misuse Gallery or remix features, attempt to abuse the platform, or otherwise violate SkinMorph rules.
SkinMorph may preserve removed content, reports, account information, logs, and related records when needed for legal, safety, security, abuse-prevention, or dispute-handling purposes.
9. SkinMorph Ownership
SkinMorph, including its software, interface, code, design, visual assets, models, sounds, branding, workflows, and related materials, is owned by SkinMorph Studio LLC d/b/a SkinMorph or its licensors.
You may not copy, modify, reverse engineer, reproduce, distribute, resell, sublicense, scrape, or create derivative versions of SkinMorph or its code/assets without written permission from SkinMorph.
You may use exports you create from your own lawful User Content, but you are responsible for ensuring you have rights to all images, artwork, logos, references, and other materials included in the export. Exporting through SkinMorph does not give you ownership of SkinMorph software, models, built-in assets, UI, brand elements, or third-party content.
You may not extract, resell, redistribute, or use SkinMorph models, assets, UI, built-in materials, or internal files as standalone assets outside the app unless SkinMorph gives written permission.
If you submit ideas, feedback, bug reports, feature suggestions, or other recommendations to SkinMorph, you allow SkinMorph to use them without restriction or compensation.
10. Payments, Subscriptions, and Refunds
SkinMorph will not charge you unless you intentionally start a paid plan, subscription, or purchase through a checkout flow. If SkinMorph offers paid features, subscriptions, Founder Lifetime access, downloads, or Pro access, the pricing, billing interval, cancellation terms, and refund policy shown at purchase will apply.
Unless a specific refund policy says otherwise, digital purchases and subscription charges may be non-refundable once access is provided. Additional subscription, cancellation, refund, Founder Lifetime, and payment-processor terms may be added before paid plans are publicly launched.
11. Tattoo and Design Disclaimer
SkinMorph is a visualization and planning tool only. It is not medical, dermatology, tattoo safety, body-modification, legal, copyright-clearance, trademark-clearance, or professional tattoo advice.
SkinMorph does not determine whether a tattoo, design, placement, symbol, logo, or image is safe, lawful, appropriate, original, cleared, or suitable for your body or intended use. Always consult a qualified tattoo artist or other appropriate professional before making permanent body, product, or design decisions.
12. Warranty Disclaimer
To the fullest extent permitted by law, SkinMorph is provided “as is” and “as available,” without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, or error-free operation.
13. Limitation of Liability and Indemnity
To the fullest extent permitted by law, SkinMorph Studio LLC d/b/a SkinMorph will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost projects, lost content, business interruption, user disputes, rights claims, tattoo outcomes, or reliance on visual previews.
You agree to defend, indemnify, and hold harmless SkinMorph Studio LLC d/b/a SkinMorph from claims, damages, liabilities, costs, and expenses arising from your User Content, your use of SkinMorph, your violation of these Terms, or your violation of another person’s rights.
14. Governing Law and Disputes
These Terms are intended to be governed by the laws of Arizona, without regard to conflict-of-law principles, unless another law is required to apply. SkinMorph may add a more detailed dispute-resolution section before public launch or paid plans. Do not rely on this section as a final attorney-reviewed dispute clause.
15. Changes to These Terms
SkinMorph may update these Terms from time to time. The “Last updated” date will show when the page was last revised. Continued use of SkinMorph after changes means you accept the updated Terms.
